Terms of Service

These Terms of Service ("Terms") govern your access to and use of GigMoPay's platform, mobile application, and related services (collectively, the "Service"). By creating an account or joining the waitlist, you agree to be bound by these Terms.

1. About GigMoPay

GigMoPay provides African freelancers with virtual foreign bank accounts (USD, EUR, GBP) and local cash-out capabilities via mobile money and bank transfer. We operate through licensed banking and money-transfer partners in each supported country. GigMoPay itself is the technology layer; regulated payment execution is performed by our licensed partners.

2. Eligibility

To use GigMoPay you must:

  • Be at least 18 years of age
  • Be a resident of a supported country (currently: Cameroon, Senegal, Côte d'Ivoire, Nigeria)
  • Have a valid government-issued identity document
  • Use the Service for lawful purposes only — personal freelance income, not on behalf of a business entity (business accounts coming soon)
  • Not be subject to any sanctions list or regulatory restriction

3. Account registration and KYC

You must complete identity verification (Know Your Customer / KYC) before sending or receiving funds. You agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. Notify us immediately at support@gigmopay.com if you suspect unauthorised access.

4. The waitlist

Joining the waitlist does not create an account or entitle you to access the Service. Waitlist positions are offered at our discretion, prioritised by country and signup date. You may remove yourself from the waitlist at any time by emailing privacy@gigmopay.com.

5. Supported transactions

5.1 Receiving funds

GigMoPay provides virtual account numbers that your clients can use to pay you via local bank transfer in USD, EUR, or GBP. Incoming transfers are credited to your GigMoPay balance once cleared by our banking partners, typically within 1–3 business days.

5.2 Cash-out

You may initiate cash-outs to a registered mobile money wallet or bank account at any time. Cash-out requests are subject to exchange-rate conversion at the mid-market rate displayed in the app at the time of the transaction, plus any applicable fees shown before confirmation. You are responsible for ensuring your payout details are correct; GigMoPay cannot recover funds sent to an incorrect number or account.

5.3 Transaction limits

Minimum and maximum transaction limits apply and vary by country and verification level. Limits are displayed in the app and may change with notice.

6. Fees and exchange rates

GigMoPay charges a transparent fee shown on the cash-out confirmation screen before you confirm any transaction. There are no hidden spreads, monthly subscription fees, or account maintenance charges during the early-access period. Exchange rates are sourced from interbank markets and updated in real time; the rate locked at confirmation is the rate applied to your transaction.

7. Prohibited uses

You may not use GigMoPay to:

  • Receive or transmit proceeds of fraud, theft, or any criminal activity
  • Evade taxes or circumvent currency controls
  • Fund gambling, adult content, weapons, or other restricted categories
  • Conduct transactions on behalf of third parties without disclosure
  • Attempt to reverse-engineer, scrape, or circumvent any security measure of the platform
  • Create multiple accounts to circumvent limits or restrictions

Violation may result in immediate account suspension, freezing of funds pending investigation, and reporting to relevant authorities.

8. Account suspension and closure

We may suspend or close your account if we reasonably suspect fraud, regulatory violation, or breach of these Terms. Where legally permitted, we will notify you and provide an opportunity to respond. Funds held at the time of closure will be returned to you net of any fees or amounts owed, unless prohibited by law or court order.

You may close your account at any time by contacting support@gigmopay.com. Account closure does not affect any rights or obligations that arose prior to closure.

9. Intellectual property

All content, trademarks, logos, and software comprising the GigMoPay Service are owned by or licensed to GigMoPay. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee uninterrupted access or that exchange rates will meet your expectations. We are not responsible for delays caused by third-party banking partners, mobile network operators, or force-majeure events.

Nothing in these Terms constitutes financial, investment, tax, or legal advice. Exchange rates are informational; you bear the currency risk of holding a non-local balance.

11. Limitation of liability

To the maximum extent permitted by applicable law, GigMoPay's total liability to you for any claim arising under these Terms is limited to the fees you paid to GigMoPay in the three months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or loss of data.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in those cases, the limitations above apply to the fullest extent permitted.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which GigMoPay's primary operating entity is registered (details available on request). Any dispute that cannot be resolved amicably within 30 days will be referred to binding arbitration under the rules of a mutually agreed arbitration body. You retain the right to bring claims in your local small-claims court for disputes within applicable monetary thresholds.

13. Changes to these Terms

We may update these Terms from time to time. We will notify registered users and waitlist members by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
